Child rapist can view porn, court decides

PORT ORCHARD -- A Kitsap County Superior Court judge overturned a previous ruling and decided a man convicted of inappropriately touching a 5-year-old girl can watch porn once he is released from prison, the Kitsap Sun reported.

Maxphil David Laue is eligible to be released from a medium-level state prison in 2020, following his 2012 conviction of first-degree child rape. Release conditions previously mandated that Laue be restricted from accessing a computer and viewing pornography or sexually explicit materials once released.

However, Laue's attorney successfully contested Laue's release conditions in court recently, claiming the conditions were "overly broad," the Sun reported.

Appeals judges sided with Laue, saying the pornography related conditions are "unconstitutionally vague," and bizarre since there was no evidence he used a computer, the Internet or a cellphone to perpetrate his crime.

According to the Sun, Laue may still be have to undergo polygraph tests when he is released.
